Cybercab numbers grow in Houston, hard evidence in the Dutch HW3 lawsuit, FSD v14 Lite as a hedge, ETSC lobbies across borders

Actual Cybercabs have moved from staging to deployment at sites (about 45 in Houston, up 50% on the previous week, with 100+ waiting at Giga Texas). That is first-hand physical evidence of the production ramp, but scaled operations are still a long way off (the volume-production target is the end of 2026, and Musk has hinted they will join the fleet in July

or August). Meanwhile the negatives in Europe are piling up. On 13 May the Dutch RDW confirmed in writing that HW3 was never submitted for type approval. That punctures the promise that the whole fleet can be upgraded to unsupervised FSD, and it is the core evidence in a collective claim by about 7,000 people. ETSC has written to transport ministers in several countries urging them not to recognise the Dutch FSD approval. Pushing FSD v14 Lite to HW3 at the end of June is a hedge, but in itself it amounts to an official admission that HW3 cannot run the full v14.

Key evidence

  • About 45 dedicated Cybercabs were photographed at the Houston Robotaxi site this week, up 50% on last week
  • Over the same period, 100+ Cybercabs were staged and waiting at Giga Texas
  • Previously only 42 vehicles in Texas were approved for driverless ride-hailing, and fewer than 20 were actually on the road without a driver at any one time
  • The Cybercab volume-production target is the end of 2026, and Musk has hinted they may start joining the fleet in July or August
  • On 13 May the Dutch vehicle authority RDW confirmed in writing that HW3 hardware was never submitted for type-approval review (no application, no rejection, no appeal)
  • In the Dutch collective claim by nearly 7,000 people, the core evidence is that HW3 was 'never submitted at all', not that it 'failed approval'

  • HW3 owners must pay for new hardware to upgrade to Robotaxi, which clashes with the narrative of a 'free upgrade for the existing fleet'
  • Tesla plans to push FSD v14 Lite (a slimmed-down version of point-to-point autonomous driving) to the global HW3 fleet at the end of June
  • v14 Lite amounts to an official admission that HW3 cannot run the full v14 or unsupervised FSD
  • ETSC (the European Transport Safety Council) has written to transport ministers in several countries (naming the Netherlands, Belgium, Lithuania and Estonia), urging them not to recognise the Dutch FSD approval
  • ETSC points out that the EU lacks an independent crash investigation body like the US NHTSA or NTSB
  • Sweden's TRV had already formally recommended rejection

Catalysts to watch

  • EU TCMV meeting on 30 Jun (a key milestone for EU-wide FSD approval)
  • FSD v14 Lite rollout to the HW3 fleet at the end of June (user feedback)
  • Cybercab may start joining the fleet in July or August (as hinted by Musk)
  • Q2 earnings on 22 Jul (the next test)
  • Cybercab volume-production target for the end of 2026

Risks

  • Obstacles to EU-wide FSD approval are the most certain negative variable right now
  • The Dutch collective claim is escalating, strengthening the argument that HW3 hardware cannot deliver what was promised
  • If v14 Lite is poorly received after rollout, it would end up confirming the claimants' argument
  • Cybercab counts are still 'sightings', not official operating numbers, and scale is still a long way off
  • Negatives in Europe keep accumulating (Sweden, plus ETSC's cross-border lobbying)
  • About -11% YTD. Closed at $400.49 on 18 Jun.
